・建替え事例の多くは“等価交換方式”に基づくもの。
・アメリカ・イギリスは、特別決議による「区分所有権の解消制度」がある。フランス・ドイツは、建て替えはもちろん、 区分所有解消を多数決で行うという概念そのものがない。
・“老朽化マンション対策会議”(椎名武雄会長=日本アイ・ビー・エム名誉相談役)は「区分所有権の解消制度創設」を提言している。これは簡単にいえば「建物解体して、土地を売り、お金を山分けして解散」。行政処分の範疇で行うため“違法性があるか”だけが焦点となり、ゴネることが無意味に。わずかなお金を渡されて終わり、となるケースも出そうだ。
